Terms and conditions for artists

Artist  Information:

The artist undertakes to maintain their listings with the site for a minimum of 90 days. The artist must ensure that the information contained therein is both up to date and accurate. The artist acknowledges that no direct contact information may be entered into areas displayed on the public pages of the site and that such information must be removed immediately upon request.

Pricing:

Shipment costs will be added to the pricing set by the artist, and will be the entire cost of the work if sold. Once an order has been received for a work this price may not be amended without the express agreement of mauritianart.com.

The work exhibited on the site can only be sold by mauritianart.com. (Unless agreed otherwise)

Should the artist be approached directly by a buyer, to purchase the work that is exhibited on the mauritianart.com site, the artist would have to get prior agreement from mauritianart.com, special conditions will apply. Addendum ‘A’

Payments:

Payment will be due to the artist 10 working days after satisfactory acceptance of the art item by the buyer. Payments to artists will be made once a month, on the 30th of the following month, notwithstanding the number of items sold on behalf of the artist by Mauritian art during the current month.

Delivery of the work:

Once the work is sold and PAYMENT received by the bank, the bank will notify mauritianart.com. Moneys will be held in the account of Sirius Projects Ltd, the registered holding company.

The art work will be wrapped /packaged by the artist, or if preferred the art work can be delivered to mauritianart.com, where the art can be checked and a small fee will be charged to the artist for the wrapping or packaging. It is the artist responsibility to ensure that his work is securely packed before delivering the package to mauritianart offices. (Delivery can be arranged to suit the artist and Mauritianart.)

Once the artist has been advised that his work has been sold, he has three working days to have the art work packed and delivered to Mauritianart.com. Mauritianart.com will be responsible for the art work until it has been received by the purchaser.

Deliveries will be done by a reputable and recognized international courier.

The delivery charges and insurance will be added to the purchase price of the art piece.

Custom duties, taxes and charges levied by governments on arrival are EXCLUDED.

The work will be delivered to the purchaser and opened in his presence. The signed delivery voucher by the purchaser will be proof that the deal is complete.

On receipt of the signed voucher, Mauritianart.com will advise the artist that the deal is complete.

 

Suitability of material (Acceptance of item to be placed on the site)

Mauritianart.com intends to protect the artist and the buyer and is committed to maintaining a quality product. To this end we will monitor the contents of all products submitted by artists and reserve the right to remove any material which we feel is unsuitable for the website. Artists may contact us if they feel the reason is unjustified.

Quality of material:

The quality of the artwork photograph is very important: We will require a photos size of pictures 800 x 600 pixels.

For the site to be recognized internationally we need to maintain a high degree of quality,

Copyright:

The artist warrants that the work submitted for sale on the mauritianart.com site is his own composition and original work and that such art material does not infringe on the copy right of any other artist or any other third party.

Indemnity:

You hereby indemnify and hold mauritianart.com harmless from any damages, expenses, claims (including legal expenses) incurred by mauritianart.com, arising out of any actual or alleged infringement of copyright or property rights.

Liability:

Mauritianart.com will not be liable for any loss of revenue, profits, data, and consequential damages arising in connection with this agreement, even if we have been advised of the possibility of such damages or if such damages were reasonably foreseeable at the date of this agreement.

We cannot guarantee or make representation that the site mauritianart.com will be uninterrupted or error free, and we will not be liable for the consequences of any interruptions or downtime.

Permission:

The artist gives mauritianart.com the right to use any image uploaded on the site to be used for marketing and promoting the site.

Miscellaneous:

In the event that mauritianart.com is unable to comply with its obligations due to circumstances beyond reasonable control, mauritianart.com shall not be liable for such inability to comply with its obligation or resulting in delays.

All transactions in relation to these terms and conditions will be conducted in English.(French version is available on the French side of the web site.)

Any dispute shall be submitted to the jurisdiction of Mauritian courts.

The artist agrees to be bound by any electronic affirmation, assent or agreement transmitted through mauritianart.com web site. The Artist represents and warrants that he has the authority to agree to this Agreement. The Artist agrees that any decision or action to click on an "I agree", "I consent", or other similarly worded "button" or entry field using a mouse, keystroke or other computer device, will indicate the artist is agreement and will be legally binding and enforceable and the legal equivalent of the Artist’s handwritten signature.

Addendum ‘A’

Should the artist be approached by a particular that has seen the painting on mauritianart web site?

The artist must contact Jean Claude and inform him that he has a buyer for art piece ‘x’.

Normally the artist will sell the art piece at the same price it is advertised on the mauritianart web site, and pay the commission due to Mauritian art.

If the artist wants to sell the art piece at a discounted price, he is entitled to do so, but the commission of Mauritian art will then be based on the discounted figure.
